Three claim scenarios we see most often

Failure to disclose material defect

Buyer sues 18 months post-close, alleging the listing agent knew about a flooding history. The seller didn't put it on the disclosure form, but the agent had taken photos of a prior water event in the basement. E&O defends the disclosure dispute and the negligent-misrepresentation count. The single highest-frequency claim category for residential brokerages.

Dual-agency conflict allegation

A brokerage collected commission from both sides of a transaction. Six months later, the buyer alleges the listing-agent-doubling-as-buyer's-agent steered them toward an over-priced offer. E&O defends; the right policy form has dual-agency coverage written in, not sub-limited.

Wire-fraud / fraudulent transfer instructions

A buyer follows fake wire instructions and loses $375K of closing funds. They sue everyone in the transaction. Cyber funds the forensic investigation and the buyer's loss; E&O defends the negligent-handling allegation. The case routinely settles for six figures.
