Cyber Liability

New insurance policies have emerged to fill the gap between your E&O policy and your General Liability policy.

Cyber Liability has gone from a luxury to a near-requirement for residential real estate brokerages. The reason is wire fraud. Real estate transactions involve large, multi-party wire transfers between strangers operating under time pressure — exactly the conditions threat actors look for. Business Email Compromise (BEC) attacks targeting real estate agents now run into the hundreds of millions of dollars in industry losses every year.

Cyber Liability covers two distinct things: 1st-party losses (the brokerage's own funds lost to wire fraud, plus the cost of breach response, forensics, and notification) and 3rd-party damages (when a client sues the brokerage after their wire was redirected). Both matter, and both are routinely uncovered by standalone E&O policies — even policies that say they include 'cyber' as an endorsement.

General Liability

A standard policy for all real estate brokerages — covering BI/PD and advertising injury for the office itself.

General Liability covers the bodily injury, property damage, and advertising injury exposures that come with operating a brokerage as a physical business. Visitors trip in your lobby. A vendor damages your office. Your marketing inadvertently uses someone else's photo. These are GL claims — not E&O claims — because the harm has nothing to do with your professional services.

Most brokerages need GL alongside E&O for two reasons. First, the franchise or office lease usually requires it as a condition of doing business. Second, even where it's not required, the alternative is leaving the brokerage entity exposed to claims that pure E&O won't touch.
